Defective Products
Products that are placed into the marketplace for consumer use should be designed and manufactured so that the consumer can use and enjoy the product without fear of being harmed. Unfortunately design defects and manufacturing mistakes can lead to serious injury.
In such cases the company that designed or manufactured the product and placed it into the market is strictly liable for the injuries that their product causes. This means that liability in such cases does not need to be proven.
To prove a products liability claim the following requirements must be met::
• The product has an unreasonably dangerous defect.
• The dangerous defect caused an injury during the use of the product.
• The defect is a result of design, manufacturing or shipping of the product.
Additionally, inaccurate instructions for the proper use of the product may also result in a products liability claim.
